2. Object of Services
WAITER JAN provides digital automation and digitalization services dedicated to the HORECA industry. Our software platform aims to optimize the internal processes of partner locations.
The services offered DO NOT include:
- The sale of food or beverages
- The quality of services offered by collaborating locations
- Guaranteeing sales growth
3. Conditions of Use
By accessing and using our site and services, you:
- Confirm that you are at least 18 years old
- Expressly accept these Terms and Conditions
- Will not use the platform for illegal or fraudulent purposes
4. Intellectual Property Rights
All materials on this site are the property of Jan Digital S.R.L. or its partners, and are protected by copyright law.
5. Limitation of Liability
WAITER JAN is not responsible for:
- Indirect damages caused by the use of the services
- Financial losses resulting from the erroneous interpretation of data generated by the software
- Inactions of the personnel at the user's location
- Errors or temporary unavailability of the platform
6. Subscriptions
6.1 Types of SubscriptionsThe system has 2 types of subscriptions:
- Free Subscription (Abonament Free) - Free subscription.
- Starter Subscription (Abonament Starter) - The subscription is paid monthly and is valid for exactly one calendar month from the payment date.
6.2 Trial Period
- The platform offers a 14-day trial period for the Starter subscription.
- The trial period for each type of subscription is available only once for each client.
- During the trial period, the client has access to the functionalities of the chosen subscription.
- During the trial period, information about the bank card or other payment methods is neither requested nor collected.
Transaction and transition to the paid subscription:
- During the trial period, the client CANNOT make payment for paid subscriptions. Payment and registration of payment data can only be done AFTER the completion of the 14-day trial.
- Before the trial period expires, the client will be notified to decide if they wish to purchase the paid subscription the next day.
- To switch to the Paid Subscription, the client must access their personal account, enter their payment details, and pay the applicable fee.
- The paid subscription will begin on the day the payment is made, after the completion of the trial period.
- After the 14-day trial, the client will be automatically switched to the Free Subscription if they do not make the payment for the paid subscription.
Stopping Trial Access:
- The client can request to stop trial access at any time during the trial period, but will have access to functionalities until the 14 days expire.
6.3 Grace Period
- If the client subscribed to a paid subscription fails to make the payment on the last day of the subscription, they enter the grace period.
- During the grace period, the client maintains access to the functionalities of the paid subscription.
- The grace period lasts 3 calendar days.
Payment during the Grace Period:
- The recurring (automatic) payment is attempted daily during the grace period, using the registered payment method.
- The client can make the delayed payment manually on any day during the grace period.
- If the payment is successfully made during the grace period, the client transitions from the grace period back to the subscription they are registered for.
- Regardless of the day in the grace period when the payment was made, the next payment date will not be affected by the delay.
Cancellation during the Grace Period:
- The client can request to stop the subscription at any time during the grace period.
- During the grace period, access to the functionalities of the paid subscription will be restricted immediately upon cancellation of the subscription.
- If payment is not made by the last day of the grace period, the client will be automatically switched to the Free subscription.
6.4 Modifying and Stopping Subscriptions
Transition to Paid Subscription
- Subscription modifications can be done in the user's personal account.
- The modification can be done at any time during the subscription and will take effect immediately.
- Clients who are testing or have already tested the trial period can choose at any time to switch to the paid subscription by making the payment.
- A new trial period is no longer available for these clients for the same subscription.
Stopping the Subscription
- The client can request to stop the subscription at any time from their personal account.
- If you cancel your subscription, the cancellation will take effect at the end of the current billing cycle, meaning you will have access to the subscription's functionalities until the end of the current billing cycle.
- No refund is offered for the period between the stop action and its effective date.
7. Payments and Invoicing
7.1 Payment Method
- Payments are processed by the recurring payments management system provided by MAIB.
- The client must enter bank card details for payment processing.
- By entering the card details, the client consents to saving the card information for a period of one year from the date the card is registered in the system.
- Each payment (successful or failed) will be accompanied by informative emails sent to the client at the email address provided during registration.
7.2 Recurring Payments
- By making the first payment, the client gives consent for monthly recurring payments for the subscription they are registered for.
- Recurring payments are processed automatically each month on the date corresponding to the initial payment.
- During the grace period, the recurring payment is attempted once a day for 3 days. This ceases only if the payment was successful or if the grace period has expired.
- The billing moment may change if you started the subscription on a day that does not occur in a subsequent month.
7.3 Prices and Fees
- All displayed prices are expressed in EUR and include VAT.
- Clients from the Republic of Moldova will pay for the services in Moldovan Lei (MDL). The price in MDL will be calculated based on the official exchange rate published by the National Bank of Moldova on the payment date. The price in MDL will be displayed on the payment checkout page.
- The platform reserves the right to change subscription prices.
- All clients will be notified by email at least one month in advance about price changes.
8. Refund Policy
- The platform does not offer refunds for paid subscriptions. To ensure that the client is familiar with the service and quality offered by WaiterJan, the platform provides 14 free days as a trial period for each type of paid subscription.
- In case of inconvenience or problems, clients should contact their agents for the management of problematic situations.
9. Termination of Collaboration
We reserve the right to unilaterally suspend or terminate a client's access in case of repeated violation of these terms.
10. Applicable Law
These terms are governed by the legislation in force in the Republic of Moldova. For any dispute, competence rests with the courts of the municipality of Chișinău.
